Terms of Use

These Terms of Use set out the terms and conditions for use of the thought bulb ("Website") and any content, Public Forums, or services offered on or through the Website and/or through any mobile application(s) ("Application") (collectively, the "Platform").

These Terms of Use apply to end users of the Website (referred to as "Learners", "You", "Your"). These Terms of Use, including the Privacy Policy and any other terms published on the Platform (collectively, the "Agreement"), define the relationship and responsibilities between You and the Creator in using the Platform. When we speak of "Creator", 'we', 'us', and 'our', we collectively mean the thought bulb, being the creator of this Platform and the content/materials/services contained therein.

By accessing this Platform, You agree to be bound by the terms of this Agreement and all applicable laws and regulations. If You disagree with any part of this Agreement, please do not use the Platform in any manner.

1. Access and Registration

If You are an individual You must be at least 18 years of age, or, if You are between the ages of 13 and 18, You must have Your parent or legal guardian's permission to use the Platform. To access any Content offered on the Platform, we require You to register by providing Your name and email address. You may also be required to pay a fee to access the Content, if applicable. You represent that the information provided during registration is true and complete.

For the purpose of this Agreement, "Content" shall mean and include any course or session (whether pre-recorded or live) published by the Creator on the Platform, including any reference materials and text files offered as part of the Content. To access the Platform You will need a Supported/Compatible Device that meets the system and compatibility requirements.

2. License to Use

You are granted a limited, non-exclusive license to access and view the Content on the Platform for Your own personal, non-commercial use only. If so allowed, You may temporarily download one copy of any downloadable Content for personal and non-commercial transitory viewing only. This license does not grant You the right to assign or sublicense it. You may not: (a) modify, edit or copy the Content or any material on the Platform; (b) create derivative works or exploit any material; (c) publicly display or use the material for any commercial purpose; (d) decompile or reverse engineer any software; (e) remove any copyright or proprietary notations; or (f) transfer the material to another person or 'mirror' it on any other server.

"Creator Content" shall mean any audio, video, audio-visual files, images, and text materials (including .doc, .docx, and .pdfs) uploaded or published on the Platform by the Creator. This license terminates automatically if You violate any restrictions, and upon termination You must destroy any downloaded materials in Your possession.

3. Communications

The Platform may include Public Forums that enable You to communicate with us and other registrants. Use of these Forums is Your choice. You represent and warrant that You own or are licensed to use all rights in any content You post ("Learner Content"), and You are solely responsible for it. You grant us a non-exclusive, royalty-free, irrevocable, perpetual and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such Learner Content worldwide in any media.

4. Code of Conduct

You agree to use the Platform only for lawful purposes. The following are prohibited: illegitimate usage of the Platform; harmful or dangerous content; hateful or defamatory content; violent and graphic content; harassment and bullying; spam; scams; privacy violation; impersonation; and unauthorised access to or disabling of the Platform (including via viruses, malware, denial-of-service attacks, or interference with the proper working of the Platform). If any violation comes to our notice, we reserve the right to refuse Your access, terminate accounts, or remove violating content at any time without notice.

5. Intellectual Property

We own all information and materials, including Content and Creator Content, provided or communicated to You by or on behalf of us, including the Platform, trademarks, trade dress, logos, wordmarks, illustrations, images, the layout, design, look and feel of the Platform, and any software owned by or licensed to us ("Creator's Intellectual Property"). You do not acquire any ownership rights to the Creator's Intellectual Property by use of the Platform. Any unauthorised use, reproduction, modification, distribution, transmission, republication, display or performance of the Creator's Intellectual Property is strictly prohibited.

6. Feedback

If You submit suggestions, ideas, comments, or questions containing product feedback ("Feedback"), You grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right (with full right to sublicense) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form.

7. Payments and Refunds

To register/enrol for any Content, You may need to pay a fee ("Content Fee"). Please refer to our Platform for pricing. Payment is processed through third-party payment processors and may be subject to applicable taxes. Once You purchase access to a Content on the Platform, the same cannot be cancelled and there shall be no refund of the Content Fee, unless otherwise stated in our Refund Policy. We do not capture and/or store any of Your sensitive personal information.

8. Disclaimer

The Platform is provided to You "as is" and "as available" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Creator expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. The Creator makes no representation or warranty that the Platform will meet Your requirements, achieve intended results, be compatible with other software, operate without interruption, or be error free.

9. Limitation of Liability

In no event shall the Creator be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Content or any other materials on the Platform, even if the Creator has been notified of the possibility of such damage.

10. Indemnity and Release

You shall indemnify and hold harmless the Creator and, where applicable, its officers, directors, agents and employees, from any claim or demand, including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of Your breach of this Agreement or Your violation of any law, rules, regulations or the rights of a third party.

11. Links to Third Party Websites

The Creator has not reviewed all of the sites linked to its Platform and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement. Use of any such linked website is at Your own risk.

12. Governing Law and Jurisdiction

Any claim relating to the Platform shall be governed by the laws of the Creator's home jurisdiction without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts at the Creator's home jurisdiction.

13. Miscellaneous

We reserve the right to make changes to our Platform, policies, and this Agreement at any time. Any waiver, assignment, severability and force majeure provisions apply as described herein. If any provision is deemed invalid or unenforceable, that provision will be limited to the minimum extent necessary so that this Agreement otherwise remains in effect.
